I am pretty much in the same boat and I think the reason for most worrying is not your GC but the financial impact it might have on you.
Contact your insurance ( They will provide the lawyer for your defense) You will not need to pay for the services. If any damage is awarded more than your policy maximum that becomes your liability- But the onus of collecting is on the plaintiff - They cannot file criminal charges because you do not have money to pay- So your GC would not have issues though they can freeze your pay from the employer. All of this is provided that they dont settle out of court which they do lots of time.
The only request keep this thread updated through your progress so that others can refer to this if they happen to fall in the same position.

I was expecting a lot of opposition to this, but so far the tilt shows more Yays than nays. The sampling, however, is still far too small and perhaps not representative of the vast majority of IV membership.
Not the final verdict, but it's great to get input on this debate and thought process.

We all will have to work to make the injustice visible; only then will the employers start behaving.
We all remember there used to be a IV voice member who used to leave abusive comments to everybody. Once we all made a hue and cry about this Pappu took action against him by disclosing his identity and since that day we have not seen any complaints by members.
Yes. That member and probably other such members are now on other site posting anti-IV posts.....
It is shameful to have such members among us.
Anyways, good thread. This site should help people fix the broken system rather than abuse each other or track all day. I hope due to the discussion, people can get some ideas and take action against such employers. IV will be willing to help as needed.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

Your arguments don't hold water because:
=> With a PhD - one can get GC very soon because EB1 is mostly current...so don't say that EB3 are cutting in line.

This person has an option of moving to EB2 BUT it is not easy as it sounds ..if person stays with same company, they will be reluctant to file his GC from scratch in EB2...going to another company has its own risk.

Because of delayed GC, people can't make important decision of their life - like where to stay? In US, In India? where to buy house etc?

It is not right to screw people by putting them in such a big limbo ...get their GC in 7 to 10 years.
Try to put yourself in these shoes - After taking all the required courses and passing your thesis ...if somone grills you for another 7 years before giving you the status of "PhD" ..how would it fill like ? Like a "bicentenary man" (Watch the movie, if you haven't)!!

Trust me ...there is nothing better that that feeling.
I am proud of what I did as a young student leader in 1980 in BITS Pilani. When I see new students from my school, I feel happy that I did have a huge impact on their lives....
But .... I also feel sad when I see a bunch of totally passed out guys, who refuce to do anything on the initiatives of IV.
I bet 90 % of IV members are below 35 years but are totally passed out.
BOTTOM LINE IS.... LET US FIGHT & would not accept status quo. We did not come to US on boats & horseback.....

I mostly get reds for being honest and stating the facts but that doesnt matter. I have to agree with Nathan, dont get emotional, lets see how to get out of this mess. As you stated, your employer didnt invite you, the only thing he should have done that he didnt do was recalled your petition when it became effective. He will get away with a warning and a small fine unless he has done the same as a pattern.
You can get him in real trouble, (of course but only by doing damage to yourself) by proving you paid the money for the H-1 and I sure here too, you would have given him a check and he would have given a company check to USCIS and you are going to make life more difficult for you than for him as proving you paid the money for the petitionis going to be very difficult.
This is the time to sit back and think what is your real goal. I guess, it was to come here and work hard and succeed not make life miserable for everyone involved. Trust me Honey attracts more flies than vinegar. Speak to your employers softly and try to find a solution. If you need help finding a job, I am sure there are plenty of avenues, especially with the market improving.
Now dont jump into conclusions, that I am another consultant or work for a consultant. I am neither.

Driving License should not be a problem as these days the rules have been relaxed dramatically. In NY they give license for 5 yrs irrespective of ur I-94 date. Also it depends on how many yrs you have left with H1B.
In some states they are even planning to give for illegal immigrants. As legal immigrants we can renew Driving license. But it is a valid point for unmarried, as they have to keep it active until they bring their spouse to USA.

Interestingly I was discussing this with a friend of mine and he took his EAD/AP to the DMV and was expecting to get the DL valid for the period of EAD, but the officer insisted he get the I485 receipt and gave the validity like every body else because he is in AOS(I guess 5 years). That was a pleasant surprise for him.

second response :- As per our info on my screen, it is not yet assigned to IO and neither pre-adjudicated. One person says one thing and another says another thing. I do not know what screen they are looking and how they are pulling info. What is the point of puting CSR if they have half baked info or worse no info on where the case is.
Have infopass appt late next week. Guess another garbage collecton day..:-)

However this smacks of unfairness as well. See this comment on Greg Siskind's blog (http://blogs.ilw.com/gregsiskind/2007/07/service-centers.html#comments) in response to the news about TSC holding the applications while NSC's been retirning them and some July 02 packages have been returned as well.

Where did you get this news? If they partially returned some cases received on July 02, it is very very very unfair for those got returned. They were the first getting in the line and now they have to wait at the end of the line??? If USCIS is going to treat the returned cases that way, they will face more lawsuits to come. If they are to hold later on cases, they have have have to allow the returned cases to be sent back and put in front of the line, with delivery notice as the proof of getting sent back.
This is very annoying notice indeed.
