Is it correct to say only nebraska Service center is issuing the rfe because they are pre adjudicating while Texas service center is not issuing rfe because they are not pre adjudicating 485. A vast majority of people getting rfe on 485 (95% or more) are from nebraska Service center.

1. As for as I can see the 45-day rule comes in to force only after the rule is published in federal register. So all LCs approved after this publication will have 45days of life and has to be used by the original applicant. It's still a grey area as to how LCs approved before the rule publication will be affected. From immigration-law.com, my understanding is that all the LCs approved before this publication will have 45 days from the date of publication and if the I140 is not filed by then they'll expire. So all LCs approved so far will have 45days from the date of publication. Now to Labor sub.
2. Substitution of labor can be done by 2 methods
a. by amending the existing labor certification before approval
b. by substituting after approval.
3. When u do either 2.a or 2.b DoL stamps a substitution approved stamp on the LC.
4. If you are doing a labor sub and u fail to get this stamp before the rules goes in to effect then ur lab sub will be automatically rejected.
5. If your labor sub is approved before the rule is published in the federal registrar then u go ahead and file I140.

- They represent a continued American heritage of immigrants chasing the Great American Dream
While H1B workers might appear to 'displace US workers', the crux of the issue is that in order for US companies to remain innovative and competitive they cannot afford to take a hoary protectionist policy in talent management.
High skilled talent finds level ground, wherever it might be.
While the old world order was about national boundaries and international competition amongst countries, the new world order is about a flat world where transnational collaboration and commerce can enable wealth and job creation in any part of the world!
The presence of high skilled foreign workers INSIDE the US
- ensures that jobs remain in the US
- ensures that resultant taxes remain in the US
- ensures that resultant investments target the US economy
- apart from ensuring US competitive and commercial advantage
The oft repeated arguments about 'local talent being available but not tapped' is borne out of a sense of elitist entitlement; something that runs counter to the great American Dream and the quest for constant innovation, creation, improvement and execution.
The need of the hour should be on how to enable successful assimilation of high skilled labor and talent into the US economy such that the economic engines of efficient productivity are not hampered by artificial tarrifs and barriers borne out of a broken immigration system.
The quest for a color-blind, talent-oriented, country-agnostic immigration system has a long and sometimes troubling, history.
While the old world afforded the luxury of years to rectify imblances and imperfections in policy constructs, the new world leaves little room for inefficient alignment of policies.
The need to fix a broken legal immigration system is as much an economic reality as it is to address detrimental effects in womens' rights (spouses' rights), labor rights and free markets.
Folks, Sorry, The petition can't be changed even if it has 1 signature. It has close to ~700. I plan to stick with this. This petition is about that particular show. You are free to start another petition highlighting general issues with Lou Dobbs.
Again we can have several petitions and send it to CNN. If we have enough numbers there will be ample pressure on Lou to state the facts.
As far as CNN hiring H1-Bs is concerned it is an example of exposing the double standards within Time Warner Inc. I believe this petition is going to make the intended impact. You are free not to sign it.

Not only is this memo discriminatory this kind of news (some folks call it rumour) has been going on for almost an year and no one bothered to believe it until this memo was released and few good attorneys like Ron Gotcher (followed by others recently) have openly posted news on Newark aiport and openly condemned the memo
Please stop arguing and lets all work together for all H1Bs(remember most of the folks entered the US on this specific visa type and now its pay back time). Do not fight I am L1 or EAD etc. Sooner or later it will affect all...Its coming ..so act faster now. If this continues for a while - majority of the smart folks will prefer to move on.
This is just my interpretation - US is no more the US it used be and attitude towards potential future immigrants (specifically for one country) is certainly changing..
One more to add - I do not want to deviate from the main topic but would like to share my comments. Stop/Delete all threads on compaints from H1B/EAD folks on public forums(example: employer not paying what should I do, No paystubs what to do, how to enter the US with status issues) we are actually feeding the beast with all these topics..hope everyone understands..As the situation is changing we need to change accordingly.

2005 : 1350 (EB2-I : 675

If you are successful, certain people will complain and make up stories how you became successful.
If you fail, the same people will makeup stories how dumb you are etc...
The best way, in my opinion, is to ignore these fools.
Those who are writing negative about IV and their leaders, do not have slightest idea on how much sacrifices they have made (family time, financially, physically, mentally etc) so that most of us could be benefited out of it. If these people think they are not benefited or does not like the idea, please don't read those post or just ignore them and move on, go to the posts that you would be benefited from and logout, I personally would like these people to share their experience and answer questions by others with their best of their knowledge, but if you can�t do that, please don't demoralize others.
And yes, I don't care about RED dots, so bring them on.

My I140 was denied on Ability to Pay....my company 2006 profit is in negative...but company is saying that the have a lot in Accounts Receivable which was not considered by USCIS....

You are right, it is very hard to digest, even for you, who seems to support it. And, if I may add, your example it too "complicated" for me. Try giving easy example for me, I am kind a slow, maybe I should get some "preferential treatment". Yes, that's the word, "preferential".
Country quota is NOT affirmative action, nowhere even close. If you are socio-politically dominated by Indian or Chinese, yes, then it is affirmative action. But if you do not come from a place there Indian and Chinese imperial powers have taken over the country, then how are you socio-politically dominated by Indian or Chinese. And if you are not dominated by Indian or Chinese in the country where you came from, then how could it be "like" affarmative action.
Maybe you yet don't know, but Indian and Chinese EB applications cannot vote and they do not have any representation in the US government. So its not that you are "not properly represented" and Indian and Chinese have all the representation. WE ALL HAVE NO REPRESENTATION. Just so that its clear.
Your next argument is that you are "overwhelmed" by Indian and Chinese so there should be country-limits. Well, I can understand that, we are very overwhelming people. You see 40% of the world population gets 14% green card, we tend to become "overwhelming" for other.
Observation: Each time, I reply to each and every part of your post. But you totally ignore what I write. You did not answer whether you think you are equal? inferior? or superior? That is the question. Hope you answer that.
Quota system treats everybody anything but "equal". And this is not just the question of equality, because I am sure you agree that we are equals. It is the question of PREFERENTIAL TREATMENT. You are in the category getting preferential treatment, so you oppose any change, you "create" arguements that you were "promised" a system when you came, and thus any change to the system, before you get your green card would be WRONG and UNFAIR. So you should continue to get that PREFERENTIAL TREATMENT. And PREFERENTIAL TREATMENT to you is NOT WRONG AND UNFAIR. Right?
