    1.Apply for new H1 petition(premium processing) for you before July 31.
    2.On approval send the H1 papers to your wife so that she can get H4.
    3. On her entry to USA apply for her I-485.

    Then you can live happily together in america.

    P.S: Even when you have used AC21, in hindsight you should have got H1B instead of using EAD.

    Why do you think I should go for a new H1? I can always call my wife on a visitor visa. She can stay on a visitor visa in US for 1 year continuously. So why bother for an H4?

    Unless there are some other advantages of H4 which I am missing?

    Bull's Eye. Please start a thread with this topic. This is a very valid point.
    I hope, Skil bill has the provision to lost recapture visa numbers. If the big news Monday benefits us in having AOS filed, then we are looking at recapturing visa numbers anyways.
    Why not lobby for it ? If Dream Act can pass as ammendment in Defense Policy Act, why not SKIL Bill ?

    If they can attach Dream Act as an amendment to the Defence policy Act why cannot they attach SKILL to the same. That is the question we should be acting on.

    I think expecting Sen. Cornyn to do something now is kind of remote. He is going to be facing elections soon in 08. May be Cantwell is the one to do it.

    Pineapple .. you hit the nail right on the head. It is a misconception that everything is cool in India. There are a lot more problems than just your salary. Money is not everything . I think standard of living and less corruption , cleanliness and less crowd do count towards life.
    i know i end up getting red dots for speaking up my mind - but i dont seem to learn!

    outsourcing is a phenomenon that will slowly expand in scope beyond low-end IT jobs - but the larger issue is that overall economic activity, which was concentrated in a few cities around the world - like NYC, London, Singapore, Tokyo etc., is getting geographically distributed - today more cities/ countries have world class higher education schools, stock exchanges, hospitals, manufacturing companies, banks than ever before...as a result - starting with tier II and tier III cities and eventually NYC, Chicago etc -the pride of place held by many US cities is now going over to places like Mumbai, Jo'berg, East European cities, Brazil, Chinese cities etc......companies are choosing to list their stocks at hitherto unknown exchanges, people are travelling to India and Thailand to get medical treatment done and so on

    obviously jobs of all kinds - not just IT jobs - move alongwith the shift in economic activity - and this is not just about saving labor costs - but about overall balancing of demand and supply for land, labor, capital and entrepreneurship.

    So, those who have high skill adaptability, geographical mobility and a strong network of professional peers are likely to continue to succeed in this game...having a GC or not would become irrelevant sooner than we probably think..

    A personal comment for hpandey - not sure where you live in US- but i cant imagine how living in 300sqft lofts in NYC or shabby NJ suburbs (for many of us) and doing all grocery/ laundry/ housekeeping/ NYC type commute on your own can be any worse than living in delhi or mumbai or bangalore with driver, domestic helps etc. :-)

    Sent both the faxes.

    As of now, I believe 217 faxes have been sent.

    Last time, I had got 7 of my friends to send the fax ( against my target of 10 ). to make up for the poor performance and to contribute a little bit to the huge efforts done by the core IV team, this time I'll get 25 on Monday when I'm in the office ( good that my manager is out of office :-)

    Finally after repeated expedite requests, SR, etc, I just received a call from my local congressman that NSC mentioned to them that AP renewal has been approved. I just saw a LUD update yesterday and today in my and my spouse's AP online case status. Its still sitting in initial review only. Hopefully it will show me approved in a day or two. Local congressman told that they will keep my case open until I call back and let them know its approved. Hoping to see an approval soon, will keep you all updated.

    :confused: I have

    EB2 140 Approved Feb 2006

    EB3 140 approved June 2004

    My Lawyer says that when they filed my 485 in July 2007, they sent both 140 petitions. IS THAT POSSIBLE ?

    Now that the dates got current in Aug 2008 bulletin , I asked them to proceed further so that my case could be adjudicated.

    They suggested me to wait and see since ,now, my original EB2 is current anyways.

    My question is, Is there any way to find out which category (EB2 OR EB3)will USCIS consider my 485 case to be ?

    Should I request infopass now or wait ?
    Yes, in my opinion, you can file with two I140s, especially, if you want to use category of one and PD of the other. You can find the PD for your 485 on your 485 RN and from that you can deduce that they are looking at EB3 or EB2 I140.

    Waiting for Aug/08 and calling USCIS for opening a SR is the good way to ask them to work on your case.

    its a really good discussion, thanks to all people who have provided valuable information. I am a Consultant throughout my career and never lead a team but now planning to change gears and move into project management. When I goolged about the requirement to take the exam, Lot of PMP training institutes came up and they are charging about $2000 for training and they say its a 5 day course, guarantee to pass bhla bhla .... My first question is it required to take these training classes? if not how to become eligible for to take the exam, Please advice.

    Also Mr O said out look for Eb2 india is grim and could have delay for decades .. where Eb3 india can be set to Oct 2001 in oct 2009. His whole prediction is based on current demand from USCIS.

    Lets says he USCIS has 50k Eb2 india and 70k Eb3 india in back room. Now they both have 3k visas in a given year . if USCIS process ( Pre adjucted ) 40k Eb2 india cases and 4k Eb3 india and bring to DOS , DOS may think there are 10 time more cases in Eb2 india so it can take decades while Eb3 india has only 1k extra so it can be in a year. but reality is different.

    hope that makes some thing clear to members..


    Agree with that as well...that may impact PD determination (and it MAY), but the fact is:

    EB2 and EB3 India people with PD after 2005 (just an arbitary year) will not get GC unless there is spill over....it will be 20 yrs without spill over....

    Hello All,
    I suggested this in my last two posts and I am suggesting this again. Emails , faxes to Rep will not create visibility of the problem. What we need to do is, do something big, like a DC rally again. One of the benefits behind doing this will be, everyone in this country i has their eyes on DC for presidential elections. Hence more visibility for us.


    Secondly the topic of these three bills is hot, if we don't do anything now, it will turn cold, and then will be forgotten.


    What we really need is a huge volume of high skilled workers in DC, not just a handful. Please let us all get together in DC again and push for these bills. We will get a lot of visibility. How about sending flowers to congress members?


    Please let us all act on it!!

    How does one get to know if his Labor Substitution was rejected? If a Receipt Notice was received does that mean that it was accepted? And, can they reject it later?
