My dad came to US in 1971 and got a green card at the airport under "Employment based 3rd preference category(For engineers, Doctors and Chartered Accountantss)" though he went back after a few years. Thats how they used to give Green Cards in those days. Lot of engineers, doctors and chartered accountantss migrated in the beginning of 70s. After few years they stopped that and there was a lot of opposition to Indian professionals (professional rivalry), later stage people found it difficult to survive the rivalry, a lot of doctors went through hell when they found themselves getting fired from residencies and denied jobs. Things are a lot better now as these things are very less heard of these days.

I asked one of my friend (who is from retrogresed country) whether he is aware of IV, a group of "like-minded" members working on immigration retrogression related relief?
He quipped me back saying that he is aware of IV and IV is NOT "like-minded" group but "Money-minded" group of people, keeping on asking money all the time....Definately, its sending wrong signal...

It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.
I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.
PD Dec 2005, EB2, RD for 485 Sept 2007. Welcome notice August 5 2008.
For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....
For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.

However, as far as access to some information and benefits goes, this can be restricted to members. If you think this issue impacts you as severely as it does, why the hesitation to ensure something gets done about it, and get regular access to information and benefits without the clutter?

I guess you are talking about premium membership like wsj etc. I am not sure a free exchange of ideas can occur if we put our membership for sale by restricting access to some parts of the website. IV will lose some of its sheen and I am not sure the tradeoff in membership $ is worth it- dunno just doesn't feel right in the gut

Yes! on IV you are supposed to say only good things about IV (though IV is "grass-root" non-profit) but no free speech here :confused:

I too got a soft LUD. My PD is Oct 06. But my spouse and my children did not get any LUD?
I am wondering why they did not get one. Any thoughts?

Lets move on and focus on this main topic...
Here are my observations.. Correct me if I am wrong..
1. L1 option for IT is essentially killed
2. Small IT companies will limit the headcount to 50 per company. It doesn't cost much to have more than one company. So no major changes to H1B Desi companies.
3. Most of the big American companies will not offer new H1B with 180 days, since most of them would have had layoffs.
4. Most IT companies will start spending a lot on lawyers. So they will be rich. There will be lot of audits.
5. Companies will complete PERM and I140 before getting a guy onsite, only if people are really interested in coming to USA any longer.
6. Need more clarity on where H1B outsourcing will be stopped...

IV core team is very active and working hard. Just because we do not see their posts on the forum does not mean they are not active. Aman Kapoor or Waldenpond- IV founder is very much active and working hard on this mission despite having his greencard. We have regular daily discussions as a team and he is one person I have seen who sleeps, drinks and live this effort all the time. He has spent his personal money to travel to DC and still takes time off from work to travel to DC on regular basis. Likewise there are others who are committed to this effort and are working hard on the tasks assigned to them. You see me most of the time writing on the forum because in the core team, this is the task assigned to me. I communicate with members. If we have everyone posting on the forum, it will not be a good use of our limited time off work on daily basis. Also know that IV is not forums. Just by writing on the forums, nothing ever gets done on the hill. There are several tasks that we have to do in this advocacy effort to get something done. You can see more regular updates on the donor forum on what we do behind the scenes. It takes lot of effort, commitment and patience to be active in this effort because results are not immediate or guaranteed. But with our efforts we have have had our successes and we are positive about the future successes. The key is to be consistent, persistent and passionate about this advocacy work. We need to understand that we as an organization represent hundreds of thousands of people suffering due to the broken immigration system despite following all the rules and being legal in this country. This long wait has caused lot of pain and suffereing in people's lives and careers. Everyday we feel the pressure of hopes of thousands of our members who look upto us with some ray of light. As leaders of this organization we carry this responsibility bravely every day on our shoulders and feel motivated from the support of our members and the passion we have for this cause.

Hey GG - I did not take offense to your sentiments on B Com. What pissed people off, was your tone and disgust at the poor fellow and his qualifications, especially when you know little about his ability to carry out his job, or his background. In school, or on line -- he earned those degrees. Maybe he didn't have the financial resources to attend the best schools (I don�t know what is IGNOU). His employer has retained him, so perhaps he is good at what he does. He left his home, his family and traveled to some foreign shore to earn a living, not rob a bank. Show some respect. @snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

@poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
Seems like there are victims falling for this modus operandi time after time.

I need help on the procedure of documents to be submitted , please help me on that as well.
Believe me if he is doing this as a pattern...he is already on the hook; you just need to call the Hour and wage division at DOL and give the employer details. They will take care of it and it will take 2-3 years.
Also if you file complaint, you will get the whistle blower protection means you would be able to do the transfer without even the pay stub. If you are lucky, you would not need to go out of the country.
Most of the time the end client would not be able to hire you though they conduct interview (the interview might be an eye wash or GC interview), you need to find their primary vendor/any vendor and go thru them. It all depends on your skill set and contacts.

Logiclife - you hit the nail on the head yet there are other reasons for folks not being active or contributing. I've talked to a lot of folks who have no clue about the green card process - how it works, how long it takes etc - and yes , they have been in the US for more than 3 years - Ignorance is such a bliss sometimes :-) until someone wakes them up - then there are folks who have filed their GCs but arent really looking forward to stay here - they have plans to go back eventually and really dont care about GC - there are lots of reasons - bucketing everyone of them under "they are afraid to contribute/participate" is not right - yes, I know I'll be flamed to hell for saying this :-) - but me being me - cant stop myself from sharing this.

This is a very critical Action Item and we at least need to make 300 phone calls to be heard. We only have six representatives to contact this time and We can do this.
Please use the instructions provided below to make the phone calls.
(1) Call the congressman/woman office and request to speak with the aide who handles Legislative and Immigration matters
2) If they are not available leave a VM for them
I would like Representative "Representative Name" to co sponsor bills
HR 6039 & HR 5882, HR 5921. All the three bills have wide bipartisan
support in the house and will help improve American competitiveness &
reduce the back logs associated with USCIS. All these bills are non
controversial measures that will help US to stay competitive with a
highly educated and skilled work force
(3) As usual Do NOT get into the CIR issue or illegal Immigration. If
the aide is confusing with CIR or illegal immigration, just tell them
that these are legal immigration bills.
(4) If the aide asks whether you belong to the district or not, tell
them NO if you don't. Mention to them that you already spoke with
your representative and would like the congressman/congresswoman
support.

Lately the members of IV have come to know that Aman Kapoor, the co-founder of IV has sold his house and spent around $64000/- towards the administrative costs of IV. This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.
So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.
There is a funding drive in this other thread towards reimbursing the administrative costs of IV.

In America everything should be trailable especially money matters.

Hi Friends,
I checked my status and havent received any Soft LUD, but I received a FP notice couple of days back. I am not sure what this is for..My PD is Dec 2006 (EB3) and I received EAD/AP/I140 approved. I applied concurrently during the july fiasco and already done with FP on 2007 itself.
Now i am surprised why I need to , go for FP again. I am still in H1 and my EAD is expired and havent renewed.
Can anyone shed some light in to this FP notice ???

It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.
I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.

For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....
For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.
As regards this forum. I never contributed but found this to a good source of information.
