Throwing money at scholarships and education incentives dont make people choose a profession they dont like. If they want to be lawyers and doctors and managers, they wont force themselves to go for tech degrees and diplomas just because they get thousands of dollars in scholarships.

As someone else mentioned earlier on this thread, your best bet is to counter-sue the party for >$3.25 M. Hire an attorney on contingency, i.e: you'll agree to a minimal base professional fees, say 5-10k and the rest of the cost of running this litigation will be incurred by your attorney. If you guys get a favorable outcome then say 25-75% of the $s won on this suit will be retained by your attorney to cover for his/her cost, etc.
In a case like this, it is quite possible for you to hire someone on a contingency basis.

The guys who decide to move back unfortunately don't come to this website.
During the last recession & once in a while I see lot of smart guys (lot smarter and lot more educated than myself) move back to their home country. Not because they don't have a job but due to better prospects back home (booming economy et al). They came here since America showed promise.. they left because the way they were treated was not what they expected. Bottomline America failed to holdback those brainy folks. They may have said yes to you. They probably wouldn't have bothered. So coming back to our conclusion. Wrong question.. wrong addressee..:p

We are languishing close to 85K. It is very important that we reach 150K very soon. There are some big decisions pending because of that.

Reading the thread it seems like there are a few steps being dicussed here:
1. Hunger Strike
2. Go the court way for failure of visa spillovers
3. Letters, Faxes etc etc.
4.. I am missing something that someone can add.
I am wondering if hunger strike will work. First of all hunger strike is useless unless its heavily publicized. For publicity we will need to be at Washington (maybe not )and strike for atleast a week before we get any publicity. That means risking physical health as well as professional life. Moreover we will need a large number of people to make news. It has to be a well publicized and a successful strike. It will surely have more impact than the rally.
I suggest writing one letter everyday to white house and to USCIS. If thousands of us write two letters a day everyday to President and USCIS it wont cost us much and it will be a continuous effort till we come out with a more substantial effort like a rally or hunger strike.
Feel free to blast my ideas and suggest others.
Lets be all a part of the core team and not get an opportunity to say that the core team is not doing enough

The whole premise is influence. Meaning even though the lawmaker (representative) knows that the callers cannot vote or donate to his/her campaign yet, this "yet" is a powerful incentive. They know that sooner or later you will become a permanent resident and eventually a citizen and are already contributing towards the constituency by paying taxes, there will be an incentive to work for the agenda of tomorrow's influential populous. Therefore I believe that it will not hurt to call lawmakers and will make a strong show of support from his/her constituents. Of course, this is just one avenue and other avenues are also being pursued like petitions, lobbying, flyers, campaigns etc.

This is a great point. Even if we get one time relief,that should suffice because retro might not happen in the future as there will not be 245si/195kH1bs. I hope one of the core group members might want to look at this. This will atleast counteract the exaggerated and bloated immigration numbers by the antiimmigrant groups.

But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
next 5 years. But Skil bill is asking too much(May be for permanent resolution of
gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract
large opposition and passed easily. Simlarly if H1 increase also limited for 2 or 3 years that can be passed easily as we can convince Senators like Sessions.
But if we keep on asking so many numbers of H1 and Gc and also exemptions
for Master degree then we have to wait for CIR as this will have lesser impact
in numbers compared to illegal immigrants.

Hey GG - I did not take offense to your sentiments on B Com. What pissed people off, was your tone and disgust at the poor fellow and his qualifications, especially when you know little about his ability to carry out his job, or his background. In school, or on line -- he earned those degrees. Maybe he didn't have the financial resources to attend the best schools (I don�t know what is IGNOU). His employer has retained him, so perhaps he is good at what he does. He left his home, his family and traveled to some foreign shore to earn a living, not rob a bank. Show some respect. All I have to say is .. do NOT bring parents or relatives to the US , period. Healthcare is pathetic and will rob you off tons of your hard-earned, precious savings. If you want to meet your parents/relatives, go to the home country but do not bring them here. I have heard far too many horror stories related to medical emergencies and the last thing I want is to put my parents in that kind of situation. In fact when my mother heard about the medical expenses here, she is terrifed to come here and wants me to come visit Pakistan instead, which I will gladly do.

I disagree. It all depends on attitude. IV is an organization "for the members", "By the members". If your attitude is "I will get on IV JUST because I WANT something" and "If I got it, I don't care" and "If I have questions during naturalization stage, I will get back on IV" may not mean that you have a great life or enjoy life after GC. Life after GC is not that rosy as you think. Big companies - hiring is the same for GC/h1b so u will not have preference. If you are independent and want to do something on ur own - it is not easy either - it is more stressful and challenging - this is life my friend, 95% of startups fail and these people are seen nowhere after that. Very few people are successful and that too with a lot of difficulties, hard work and faith. The "enjoy life" after GC is generally not U but your next generation (children) will bear the fruits. they will enjoy all the freedom and comforts until reality hits them in form of career and family life - this is something everyone faces.
A lot of people love to be on IV - say, if someone has answered someone's question on IV and the person is benefitted - thie person is extremely happy for the other person.
A lot of people who are active actually love and are passionate about what they are doing. Lot of people want to do their 2 cents or more - this is what this organization is all about.
Over the past 2 years of my association with IV - I have seen a lot of stones turning soft, a lot of people who never wanted to get in, are now very active and highly motivated.

In the final rule making process, there is no comment period before the rule takes effect. On the date when the final rule is published in the federal register, it becomes a binding rule and the rule-making process is complete. Certain provisions in the final rule may take effect on certain specific later date or dates, but the rule itself becomes a binding law on the date of publication of the rule in the federal register. Accordingly, unless the DOL changed the proposed rule, substitution of the beneficiary of the labor certification will be eliminated on the date of publication which includes the substitution of the beneficiary in the pending labor certification by amendment as well as the substitution of the beneficiary in the approved labor certification. For those who filed the substitution I-140 petition, the proposed rule provided that only "substitution approved" on the date of publication of the rule would survive. Substitution approved can be interpreted to mean approval of the substitution I-140 petition. For the 45-day validity of the certified labor certification, under the proposed rule, the certified labor certification on the date of publication was supposed to have 45 days to file the I-140 petitions. For the labor certifications which are approved after publication of the final rule must file the I-140 petitions within 45 days from the date of certification.
