I think each person can write their own story and here are a few writing points as appropriate.
1) How long you have been here, and how despite your contributions in work and taxes, creativity(of jobs?) and maintainineg legal status, you have been left in a difficult spot of no permanency of status.
2) How you have benefited from this country and would like to give back, and understood that to be the tradition on which america was built.
3) If you have US born Children. That it would be unjust to ask them to be brought up elsewhere.
4) That your entrepreneural ideas have been held back by your inability to have permanency of tenure here.
5) That you never understood that to be the way it is done in America. However, a little voice keeps telling you to never quit on America, as she eventually gets it right.
6) That you have been unable to buy a home due to this issue and wonder why it is that you can't help yourself while helping America. That you have a stable job, 20% down, excellent credit and the whole nine yards except the green card. That there are thousands like you waiting to jump in.
7) How the US gov't bureaucracy has "wasted" over half a million green cards already allocated annually by congress, all happened while there were years long queues and merely recapturing those visas has been blocked by gridlock.

I dont see how genuine consulting firms will be affected by this. Those who employ people on H1B with genuine clients will be OK. Only consulting firms who bring/hire H1b employees without any project will be impacted. In my opinion this will help avoid the benching practice...

If these abusers get kicked out at POE and their I140 and I485 are denied, it may make more room for those of us who have not cheated the system. If my application is in Q behind these abusers, then I surely want these guys kicked out.

For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.
Seriously, how much more immature can we get?
Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.
Legal arguments were already dealt with in the other thread, there is no basis to sue, as the porting is well established law. So is the requirements for EB2.
Regarding the EB3 to EB2 shafting EB2, well, you already know that most people will not be able to port because they are not willing to change jobs, or that the company is bit too strict about playing with immigration laws.
Also, a point to be noted when you say EB3 has had the opportunity -- you too had similar opportunities. You too could have been EB3, gained experience and converted to EB2. Instead you decided that it was in your best interests to follow your dream of getting a PHD -- a choice, I dont think you are be ruing, but for the fact that you find yourself placed behind all the guys who did not do PHD.
Plight of EB2? I think not. Even with EB3-to-EB2 porting, priority dates are well ahead of EB3 (even without the current jump, EB2 was around mid 2004), and now, I guess when it returns to normal, would be around 2005. So while not exactly current (like EB1, shouldn't they be "similarly entitled" to have a superior lead times), the wait times for EB2, compared to EB3 hardly justifies it to be called "plight".
But then again, to each his own. EB3ers other EB2ers waited almost 3 years for our LCs, people with 2006PDs did not even wait 6 months for it (both EB2 and EB3) -- and worse still are people stuck in BEC (who waited 4-6 years). And yet people in 2006 complain that they have "horrendous wait times".
EB3s saw tons of people getting through substitute labor, people who have no right to cut into the line ahead of us, significant portion of these cases (including EB2 substitution) are fraught with fraud, however the law was weak, and there was nothing that we could do to prevent such things. Lawsuits are useless for us to weed out such applicants, or even question their earlier PDs because they are protected by the then current laws.

After this step "it has to go to Rules Committee and await determinations by the Rules Committee as to how much debate will be allowed and whether floor amendments will be allowed, and if so , how many.
Then both house and senate has to vote on this bill ( if Senate have already one similar to this)
If it passed in both congress then it will go for President signature I guess.

Count me in as well. This memo is completely discriminatory and will do more harm than good. It is surprising that very few are willing to come forward and fight this abuse. I am sure that there are hundreds of affected members and a collective effort will help us all.

I am sure we have many pplicants with PD in 2002 and 2003. I would be surprised if PD moves beyond April 2002 in FY 2009.

I am sorry, not a computer guy, but can mass mailing for funding alerts from IV be possible to "loyal customers only"? I am not sure I am giving the right idea/ thought. But what I am thinking is lets say this Administrative cost re-imbursment works, can we send to selected 1000- 2000 non-core member like anzerraja or khodalmd (for example) and ask them to send money? It also could help people who are eligible to change from an EB3 classification to EB2. One would be eligible to request a transfer of the priority date from the earlier-filed EB3 petition to a new EB2 petition once the I-140 is approved. The new EB2 petition would need to be based upon a new LC for a position requiring the EB2 level of education and/or experience. (Over time, many people with EB3 cases have become eligible for EB2 cases due to increased experience and/or education, and promotions.)
This strategy potentially could shave off a few years in the queue for available immigrant visa numbers. This may be particularly appealing to those who had EB3 labor certifications filed on their behalf long ago and have had their cases pending while they have gained advanced degrees, acquired several more years of experience, and/or are offered jobs at higher levels. Keep in mind, though, that this involves filing a whole new LC under the PERM system for a new job opportunity and that the employer must actually require the additional degree and/or experience for all persons holding that job classification in order for the new case to be filed as EB2.

What makes you think you qualify for EB1? Is it because you were planning to apply in OR category? or because you wanted to apply in EA category?
FYI, a fresh PhD has very little chance to make it in EA category, and OR is applicable only for a researcher position.
It's nice to create a big fuss about your qualifications and how you have been hurt, but at the end of the day, these were choices YOU made (i.e. taking up full-time PhD instead of going to work immediately after school). Also, as someone else said on one of these never ending threads, there is nothing that prevented your future employer applying for GC for a future job for you as soon as you finish PhD :-)
So, again, if you are so qualified, and happy to live the consequences of your decision, where is the PLIGHT?

How is that possible? Did you apply for H1 before you left this country and got the approval after you came? If so you have a problem because leaving the country when H1 is pending invalidates the application.
If you had H1-i94 before you left the country. Why did you not turn it in when you at POE(xit)? You are required to do so. If you have not, you are supposed to send your old i94's to some place (I dont know where, check the web).

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
