Ok, with the latest developements, I have applied for my 485, EAD and AP this week. My current H1 expires in June 2008.
If I get married before June 2008, I can still bring my wife to US on dependent (H4) visa. My question is, for my wife
to be able to file for 485 then, do the visa numbers have to be current at that time? And if they do, and say the numbers are not current at that time, and then my H1 expires come June 08, will she be out of status and can she remain in US? What are our options then? How does this work??
Can anyone explain PLEASE? :confused:

u can keep renewing your H-1 as long as your 485 has been pending for more then 180 days.(someone corect me if i am wrong).Once u get ure recipt number ure status changes to "485 pending" and can be on h-1 as long as ure GC is approved.No matter when u get married your wife will not be out of status-so its a good decision that u applied.

long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?
Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

StuckInMuck thanks for the awesome compilation. I have a follow-up question to the guru's on forum.
I did an AC21 before my GC got approved. I did this on my EAD card and when I joined I filed my I9 form for taxes. Now after getting GC do I need to renew my I9 form or the old one stays valid?
Also since I am not with my GC sponsoring employer do I still need to follow the 6 months rule with my current employer since date of approval?
Also can we move this compilation to IV Wiki?

I spoke to him yesterday, this is what he told me 'I wrote this letter long back, neither I remember what I asked nor I kept a copy but we can presume I asked about pending I-485 applications, because just asking pending 'applications' for Indians wouldn't have made sense anyway, than it could be any application Citizenship etc, etc..

Just did a rough sketch on paper, and then drew it up in vector, no secret really... and to be honest it isnt perfect at all, but turned out ok.
I guess drawing it at a larger scale then shrinking helped with some of the fine tuning.

Lofgren issued a letter to Secretary Chertoff, she also disclosed that "It has also come to my attention that USCIS began returning visa numbers to the State Depaartment as early as Thrusday, July 5, 2007." It could be the answer to our question why they are holding July filing cases and why they stopped adjudicating 485 cases for which they pull out the numbers before July 2, 2007. What a mess
Does this mean ..Visa numbers might open up again in Aug ...?????

It wouldn't hurt to verify which 140 is getting picked up. I got paranoid because when I contacted USCIS through service request, POJ and ncsc follow up email in September, I came to know that my application is awaiting visa number when clearly dates for my PD were current since Sept 01. Then I tried calling USCIS repeatedly until I got confirmation that both 140 were indeed in place.
After I initiated these requests, my app moved from "awaiting visa number" to " assigned to supervisor" after October 1st. In fact, on Oct 6th,there was LUD on 485 and on Oct 28th, a Hard LUD on my approved 140.
InfoPass won't help much. Usually they just brush people off saying that wait till your PD is current but IO's on phone give more information.

I am 50% done with an MBA from a top 18 school. Unless you are planning to start a career in financing or economics, *I seriously* doubt that rankings would make a lot of difference. For people in IT wanting to move to a CTO/CIO position, I cannot see how rankings would make a significant difference. Instead of spending the money and resources to go to a top school, I'd prefer to invest in certifications such as CISSP, management certifications, etc and then take a degree in a less known school would be totally OK. I agree that by going to a reputable school, you may meet people there that can help you get positions in the future. So far I've got an invitation to work for classmate's team, thanks to the connection I've made at the MBA.
For those of with you without true passion for management and soft skills, you might want to consider a MSIS or MSIM instead. Those degrees usually are less expensive and less time consuming to achieve. I started the MBA planning that I would be a great CIO. After taking many courses at my MBA, I decided that the last thing I want is to be a CIO; CIO's are about people, executive management and I learned that's not where my passion is.
Can anyone provide some useful insight based on personal experienceas to how valuable is Part Time MBA for oppurtunities in India?
I am IT professional with lot of experience and currently pursuing Part time MBA from a business school which is ranked in top 25 and not in top 10.
The way I see it that it will take me around 4 years to complete it and I have to invest atleast $30,000 even if I get employer to pay a part of it.
In the end if it fetches me a top notch management position it will be well worth it. However I see limited chances of getting into management positions in US just based on MBA degree however I am not sure about India.

I do think a lot of times that Hillary has a better handle of issues and she is very articulate. Billary (yes Billary) concerns me. I think it is going to be tough to be just Hillary and not Billary.She had a good answer for it last night but it is hard beleive there will be no Billary. When employees post for job, they might say �need a citizen or gc holder�. But never say we only need a H1-B holder. So when we have respected and followed the rules of this country immigration becomes a right as logic life suggested.

These types of employment advertisements are discriminatory and are thus illegal unless it is work that requires security clearance. I am surprised that the Department of Justice is going after employers (http://www.immigration.com/newsletter1/doj_investigation.html) who may have advertised jobs for non citizens while not going after the numerous advertisements that discriminate against non US citizens. I am aware of atleast one high profile company that engages in this type of activity in its advertisements (however one needs to apply and be rejected in order to file a complaint). The double standard is indeed disturbing :

As IV is willing to help those having issues with employers by providing a platform and interfacing with DOS, USCIS, DOL, Media, lawyers and support in any form - nothing stops people from standing up for themselves and report an abusive employer.
