It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.
I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he lies, cheats and changes his story all the time.

This bill is in House judicial committee for markup only. This bill is not tabled on house floor yet. Even after markup and voting, this bill still needs to be tabled on house floor. If it gets approved there, similar measure S3414 will be brought to Senate floor for voting.

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

People, since Aman and lets not forget other core members also who I am sure have racked up a lot of out of pocket cost we as a community should gather funds for administrative cost also. GC is not just Aman's/ pappu/logiclife and others core member's dream...its OUR dream, and its not fair that in spite of knowing the time and money spent by the core members we donot share the burden.
So here is what I am thinking, there are 21000+ members of which I think 10,000 can be considered the real people (I am sure there are more..but a real conservative estimate) if we all pitch in $10 for administrative cost I think it would not put any dent in our pockets and this collective effort would not create a financial burden on any of the core members.
Even though IV is not for profit, there is no rule which says that you cannot have funds for administrative cost. In fact one rule of thumb to give to any NOP charitable organization like united way etc is to look at their admin cost. Why not IV have that.
Any thoughts!

and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. EB3 I is going to have a long wait. I had applied for Canadian green card and had received it. At present i have EAD and AP. Is it worthwhile to go into consular processing and work in canada or apply for a blue card or think about Australia. If this sounds okay how should i proceed.

Hello I got a yellow form 221(g) during my interview. Got my passport and approval back during the interview.
Are other people in PIMS getting this yellow form/ 221(g) stating that "when administrative processing is completed in your case we will contact you"?
This will allow me to decide if I am stuck in PIMS or something else.
We did not get any yellow slip. We were told that we will get VISAs within a week. But we are still waiting to get them.

Xu1, that is a valid concern. I have sent in this request to admin. But on important issues like this, please do PM admin and other Moderators in addition to public posts. The core group is so drained by all the during the week activities that posts may not be actively monitored during weekends. I think the problem is also logistical, in that we are now getting a lot of checks - which is great, but also now, the core team members handling finances must now take time out to start sending email receipts. So wait for admin and the financial people to get back to you.
Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.
Writing an actual paper check, I would see a copy of endorsement online, or using paypal I would know it's cashed out via email. But this is not the case with my bank's (bank of america) online billpay. Thanks!

To raaj2007, just getting an EAD does not nullify your H1, but if you use EAD you loose H1. Go and check with your attorney. If you use EAD you cannot enter US using H1 or H4, you have to use Advance parole.

(i) I heard after filing 485 I could change employers? Yes or no? If yes, then which state would I be in? (EAD, AP or none)?
Answer - You can change employer after 180 days of pending 485 using AC 21 and you would be in EAD and use AP to enter US
(ii) After filing 485, do I HAVE to get my wife into US before the dates retrogress again?? Whoa never heard that...are you sure?
Answer -Yes, if you dont, you would not be able to file for her if the dates retrogresses again, also to file 485 for your wife , she should be in US at the time of filing 485.
(iii) Is there no step after 485 filing that I can keep postponing to not let 485 approve (like delaying 485 fingerprinting multiple times) so that I can let 485 approve only after I am married and can bring my wife in?
Answer - No, you cannot postpone it on your own will. But if your marriage date is before 485 approval (even one day) and tour wife could not make it to US, she can come to US using follow to join process. That process is also available if PD are current.
