In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?
Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.
So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...

So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. When I filed for my I-485 in 2000, the PD was current for me for 23 months in row when it got approved. Can you believe this? PD was current for whole 23 months while I-485 was pending.
One of my goals is to help my future legal immigrants. Being a US citizen gives me vote voice and power. I am open to suggestions. I would like to help my fellow legal immigrants.
I know, the wait time is long, but it is worth it every bit.

You are right in the sense of returns but I am also looking at investing ,not 50 lakhs but small amts. The rturns may not be good but the main reason I think people invest is because of the surity that the land price appreciates more than 50% and be sure your principal is safe compared to stocks or other.

At least for the consultation phase hire a good lawyer, there are scores of lawsuits filed each year but as long there was no life threatening injuries in an accident you can get out of it. This should not be a criminal conviction and should not hurt your gc process. Again I am just assuming the back up ended in some dent to the other persons vehicle or were they walking and you hit them there were injuries involved.

if you are single and apply for 485 and get a EAD can still being ur wife from India on H4 as long as u DO NOT use EAD and DO NOT get 485 approved.
EAD to me has major benefits for the spouse. I think everyone agrees that 485 retrogression gona happen ... so if that happens u cannot get a 485 approval or add ur wife till almost close to 485 approval .. as ur PD wont be current. In this period u will never be able to use EAD as ur dependent will go out of H4 status ...
Also it is never recommended to use EAD and maintain H1 status ... so to me if you are single and have no plans as of yet to get married u will not use the interim benefits and pay EAD fee every year.
u will be in the 485 queue and if anything changes about green card u are atleast far enough to not to start ur application from beginning... also if for some reason u decide to use ur EAD the way around is ur wife to get another Visa like F1 ....

I received a call from my lawyer last week saying he got a call from USCIS asking the lawyer whether my wife got the TB Skin test done or not, as she did not get it originally as we were expecting our child at the moment.
I sent the lawyer the scanned copy of the TB skin test results and posted him the sealed envelope separately yesterday, which he was planning on Faxing over to USCIS. Today I saw a soft LUD on my wife's I-485.
Don't know what this means? Its hard to belive that my Lawyer is so proactive to send the fax right away. And I can't believe that someone at USCIS actually updated my wifes case after lawyers response...
So don't know whats going on there... Friends whats meant by pre-adjudication?

the fact that the person remembered you does not mean anything.....say, i run a hardware shop and have not sold a mousetrap in months - suddenly 3 people come in asking for a mousetrap - despite the fact that i probably get hundreds of customers - chances are i would remember those 3

can the H4 not apply for a new H1B? Is H4 barred from applying for H1B? If not, I don't see where the prob lies. plus how will this solve the retrogression issue?
Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.

Please guys. Do not rush your marriage for Green Card. I know couple of my friends ended up in bad marriage experience just becoz they are getting faster green card. Choosing right partner is more important than GC.
If you already decided on your partner and waiting to get married, then its right time. So my advise, please counsult with an attorney if you are unmarried and filing 485.

I'm sure people here dont have that agility and adaptability to adjust in India and China. Though I heard lots of gora are in Hyderabad and other cities that wont be for long term. And without people from India/China IT can't survive here. Much bigger market (than Internet) will be fighting global warming. These guys won't screw their future by doing all these nonsense laws. Let us "C" what happens.
