It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. I called the first three representatives- left VM for 2 and Brian Bilbray's office asked me to fax the material over to thier office.

Recapturing lost numbers is not a permanent solution. Per country limit 7% is ridiculous. We need to make sure we are not discriminated against by the per country limit. Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

You may not be able to attend the San Jose rally but you can still be part of the effort by volunteering to help call the members in California and inform them about this event. You can call even if you are on the East Coast. This is urgent!
This will help us focus on other logistic issues like banners, posting flyers.
Your help will make the San Jose peaceful walk a success!

Did you keep new filing fee also? When I spoke to custumer service by 800 number call, she said you have to keep new check and original sealed medical along with duplicat filing.Wish you all the best!
Same as me :D but for the fact that I sent in mine without medical. What do you guys think the chances are of USCIS sending an RFE instead of rejecting the application outright?

I found this only today.. I do not work for this employer since Jan 2008. On EAD now.. 46 days passed since the date mentioned.. not sure what is this about..

Because visa availability date was Current during July 2007 for EB2 and EB3 and it never got advanced beyond that.
So anyone who got their labor applied (PD) after July 2007 didnt get chance yet.
There will certainly be folks with EB1 though.

Hello:
I am working on EAD for company B. Company B filed H1 transfer for me before May 2007. I heard that You can transfer you H1 and EAD both with new company but I did not aware about this rule, I started working on EAD. Is it possible to go back on H1 which company B filed? I have not yet used AP for travelling abroad.

AFAIK, once you work on EAD, you can not be back on H1B. Please check this with your lawyer.
However what I do not know, and what my lawyer also could not answer till this point is, if after travelling abroad using AP, can one transfer same H1 to a new employer? I know it is possible to continue working on H1 with the same employer. But what if one need H1 transfer?

You know, there are often times we all get upset that some stupid questions make it to the list, republican debate was one such yesterday, today's democratic one looked better. I hated that they did not ask our question inspite of it being the 2nd popular one but I personally think the question was too damn narrow for them to care.
For us, it may seem the world but for them it is just a technicality/one of the several points of CIR. Both Clinton and Obama seem to always chime in and act all gung-ho about legal immigration coming first.
Whenever they are asked about any frig'n immigration question, they throw the buzz word 'comprehensive immigration reform' and that folks, covers the entire gamut. The worst part is, on this issue the entire front runners look the same, well, almost. Mitt R is against but John, Hillary and Barack all seem to sing the same koom-ba-yaa song about CIR.

Although we all live in the digital age, digital signatures of 20,000 people are less effective than 500 calls, and 500 calls is less effective then 50 members meeting their lawmakers in DC. Like it or not, that is how Washington works. We have to craft our methodology and adept to the ways that work in DC, and not the ways that sounds cool or most convenient. No one cares about how someone voted on IV's website or any other website, but they care when someone calls them and they keep a tally of the number of calls. For example, say if 99% of all the people voting (digitally signing) on Lou Dobbs show say that all H-1s should be sent home, do you think lawmakers care about that? Even if people provide names, and address, even then it is less effectively than 5% the number of people calling. Being an IT Analyst, one could fall into the trap of reasoning, but as we know, law is not based on logical and the process in which laws are made is also not logical. If it was based on logic and reason, we would not need Federal Affairs folks. Also, if we tell members to provide digital signatures, out of 20000 members, 200 people will give real names and data, the remaining people, the data would look something like First Name - Last Name as 'ABC' – 'DEF'. But members are more likely to feel comfortable in providing data to the lawmakers offcies. So you see, there are practical problems and considerations, although for the community that employs hi-technology for most part of their job, 'digital signature' may “sound” effective, but actually it is not.
Just another example, we have been advised by key decision makers, counsels, advisors and our partners for not sending web-fax. Thus we are not employing that method at this time. We pay experts for this advise, guys who know what works and what doesn't, and these guys have more than decades of experience.
We also constantly communicate with other groups and key folks at large employers some of whom we all know. We have come a long way in making these relationships to effectively run this campaign. A lot of times we are not able to disclose/explain the reason for a specific method on WWW, but before announcing and requesting members to spend their energies, we do good amount of debates and discussions with our counsel and paid strategist, which is part of the reason we pay them. In many cases we seek advice/ideas/suggestions from the top executives of the employers of some of IV members. So there is no point in this discussion. Please trust the strategy and methodology. We are high-skilled and critical ideas to conduct an effective campaign is welcome, however, we have a choice to just to be critical and do our own thing, or function as an cohesive organization acting on advise from our counsel.
BTW, just to clarify. There was no failure. We were told 2 weeks back how it will turn out, and it did exactly the way we were told. Murray-Gregg amendment could not have survived digital signatures of 20 million people. And we were told so by our counsel. But we were advised to continue to make those phone calls because these calls are counted and will have its effect for the next time. Trust us, our strategist is “The Best” one could hire in DC. He is not talking about Indians, rather he talks about H1b in general. Since India does not have equivalent social security system, US Govt and Indian Govt did not sign any contracts. Other countries like Canada / UK / AUS have mutual agreement between them and US for transferring the social security paid in US to be transferred to their home country if the alien returns to the home country.
Even Indian Govt (P.Chidambaram) I beleive is working with US Govt to get these SS paid by Indians who have returned back to India. Since the US system and Indian system does not allow with the current rules and regulations to transfer the amount, it is stalled. may be down the line even India would work with US to get these amounts back.

As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

1.Audit the companies that are suspected to abuse the H1B program i.e. enforce the laws that are already in existence.
2.Impose heavy fines on these companies.

Thanks for pointing out. I counted 16 posts correcting the error about H1-B not paying taxes.
we try to mention in our media interviews about us paying all the taxes and playing by the rules, still the anti immigrants pursue this misinformation campaign against us. We will all try to ensure that in every media interview we say that we pay all taxes..
